Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN

1. ELIGIBILITY Participants must be legal US citizens residing in the state of TX who are 21 years of age or older at time of entry. Employees of Pabst Brewing Co. (the “Sponsor”), its wholesalers and distributors, advertising/promotion agencies, their respective parent companies, affiliates, and subsidiaries, alcoholic-beverage retailers or wholesalers, alcoholic-beverage licensees, and the employees of any of the foregoing, and any other entity directly involved with this contest, their immediate family members (parents, children, siblings, spouse) and members of the respective households of these persons (whether related or not) are ineligible to participate.
2. By entering and submitting a declaration (“Declaration”), each entrant warrants and represents that: (i) the entrant meets the eligibility requirements stated in Rule 1 and is in full compliance with these Official Rules; (ii) the Declaration is his/her own original work, has not been previously published and that no rights, including but not limited to copyrights, in the Declaration have previously been assigned or transferred to any third party; (iii) the photograph submitted with the Declaration is a true and correct photograph of entrant; and (iv) entrant has all rights necessary to submit the Declaration and the photograph for use as contemplated in this contest, including all copyrights in the photograph. By entering, each entrant also agrees to indemnify Sponsor and its advertising or promotion agencies, parents, affiliates, subsidiaries, successors, licensees, agents, attorneys and assigns, officers, directors, members and employees of the foregoing (collectively "Indemnitees"), from and against any claim, liability or damages of any kind or nature, including any copyright, trademark or other infringement claim, publication or right of privacy claim, based, in whole or in part, on Sponsor’s use of the Declaration or photograph or entrant’s name as set forth herein.
3. All Declarations and photographs, will become the property of Sponsor and none will be returned. Information collected from participants will be used by Sponsor in accordance with the stated terms of this contest and with Sponsor’s [privacy policy] (link). Photographs of entrants should not depict actual drinking of any alcoholic beverage, should not depict any other slogans, logos, trademarks or other intellectual property of third parties and shall depict only the entrant.
4. By entering, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final. Participants and their Declarations may be subject to verification and investigation before being selected.
5. Entry constitutes assignment to Sponsor of all copyrights and all other right, title and interest of the entrant in and to the Declaration and photograph submitted and the right to use (in part or in whole, edited as determined by Sponsor) (i) entrant’s name and likeness, and (ii) the Declaration, in perpetuity, for purposes of advertising, promoting and publicizing this contest and Sponsor’s products, without further compensation, approval or notice. The participant whose Declaration is selected as the winner must sign and return within 10 days of receipt an affidavit of eligibility, publicity release and assignment of rights to the Declaration and photograph submitted or an alternate winner will be selected. Sponsor reserves the right to edit, adapt, publish, and use any or all submitted Declarations and photographs in all media worldwide, without additional compensation including publishing on the Internet.
6. Entrants agree that they will not assert any claim of any kind or nature, including any copyright infringement, publicity or privacy claim, against the Indemnitees, based, in whole or in part, on participation in this contest and/or Sponsor’s access to and/or use of any Declaration. Entrants release, discharge, absolve and hold harmless Indemnitees from any and all actions, suits, claims and demands of any kind whatsoever which they may have by reason of any matter connected in any way with this Contest, or that may otherwise arise in any way in connection with this contest.
7. Entrants agree that they may be disqualified immediately from further participation in the contest and their submissions and/or photographs blocked or removed from Sponsor’s website if they submit a Declaration or photograph, or commit any act, which Sponsor determines, in its sole discretion, contains third party intellectual property or which may reflect badly on the contest, Sponsor or Sponsor’s products.

Contest starts 12:01 AM (CST) January 1, 2009 and ends 11:59 PM (CST) February 15, 2009.

This contest is subject to all United States federal, state and local laws, and is void where prohibited by law.
