2009 “Win Texas Land” Promotion

NO PURCHASE NECESSARY TO ENTER OR WIN.
MUST BE 21 YEARS OF AGE, OR OLDER, TO ENTER.

1. ENTRY: Promotion begins 6/1/09 and ends 8/31/09 (the “Promotion Period”). An Official Entry Code is needed to enter.  There are two ways to obtain an Official Entry Code and there are two ways to enter.
   
   To obtain an Official Entry Code: (1) Purchase a specially marked 12-pack, 18-pack or 24 pack of Lone Star or Lone Star Light Beer and look for the code, printed inside the carton or (2) to obtain an Official Entry Code without purchase, and to receive a copy of the Official Rules, hand-print your name, address, age, and day & night telephone numbers, on a 3” x 5” card and mail it, along with a Self-Addressed Stamped Envelope (SASE), to: 2009 Lone Star “Win Texas Land” Promotion Free Code Number & Rules Request, 14241 Coursey Blvd, STE A-12, #226 Baton Rouge, LA 70817.
   
   To Enter: When you have your Official Entry Code: (1) Go to www.lonestarbeer.com and click on the Promotions link to enter the promotion. Follow the online prompts to enter your personal information and the Official Entry Code or (2) to enter without purchase mail a 3” x 5” card onto which you have hand-copied your Official Entry Code and hand-printed your name, date-of-birth, address, day and evening phone numbers and email address (if you have one) to: 2009 Lone Star “Win Texas Land” Promotion, 14241 Coursey Blvd, STE A-12, #226, Baton Rouge, LA 70817. All information requested must be provided, including the Official Entry Code. No mechanically reproduced Official Entry Codes will be accepted. Mail entries must be sent separately.
   
   All entries must be received by 8/31/09 and will become the property of Sponsor.

2. ELIGIBILITY: Promotion open only to legal US citizens residing in the state of TX who are 21 years of age or older at time of entry. Employees of Pabst Brewing Co. (the “Sponsor”), their wholesalers and distributors, advertising/promotion agencies, their respective parent companies, affiliates, and subsidiaries, alcoholic-beverage retailers or wholesalers, alcoholic-beverage licensees, and the employees of any of the foregoing, and any other entity directly involved with this promotion, their immediate family members (parents, children, siblings, spouse) and members of the respective households of these persons (whether related or not) are ineligible to participate in this Promotion. Sponsor reserves the right to conduct a background check on any potential contestant and reserves the right in its sole discretion to disqualify any person based on such background check if Sponsor determines that the contestant’s involvement in the Promotion might reflect negatively on Sponsor.

3. PRIZES: There will be one Grand Prize and 500 First Prizes.
   
   The Grand Prize is Lot: A00065 Harrington, Arrabella (Shadowlawn), Brenham, TX, 77833, consisting of one (1) residential lot. The lot has no buildings, no well, no septic system or any other improvements on it, nor has the lot been approved or pre-approved for any of the foregoing improvements. The lot may not be buildable or habitable in the future, depending on compliance with applicable laws and regulations. The lot will be conveyed subject to all: (1) existing easements of record, including without limitation all utility easements, (2) easements visible or apparent even if not of record, (3) all subdivision setbacks and other requirements, (4) restrictions and limitations, (5) standby taxes and assessments, (6) mineral rights and royalty interests, (7) Washington County subdivision regulations, (8) and any other encumbrances of record. Sponsor makes no representations about the size or condition of the land or any encumbrances or encroachments which may burden the land. Sponsor or its designee (“Grantor”) will convey title to the lot with a special warranty deed warranting only against Grantor's acts during its ownership of the lot. Winner is responsible for all taxes (including without limitation income, property and recording taxes), fees, expenses, insurance and any and all other costs incurred in connection with or associated with receipt or ownership of the Grand Prize. Grantor will pay only the prorated portion of taxes, fees and other costs and assessments made with respect to the lot for the period of Grantor's ownership of the lot. Grand Prize is strictly limited to the description above. Winner is responsible for any inspection or investigation of the Grand Prize that winner feels is warranted or prudent before acceptance of the Grand Prize.
   
   SPONSOR/GRANTOR WILL NOT PROVIDE TITLE INSURANCE. BY ACCEPTANCE OF THE GRAND PRIZE, THE GRAND PRIZE WINNER ACKNOWLEDGES THAT THE GRAND PRIZE HAS BEEN ACCEPTED IN ITS THEN PRESENT CONDITION "AS IS" AND WITH ALL FAULTS. Approximate Retail Value (ARV) of the Grand Prize is $29,900.
   
   First Prizes consist of 500 Lone Star baseball Caps (ARV: $5 each).
   
   ARV of all 501 prizes: $32,400.
   
   Odds of winning a prize depend on the number of eligible entries received.

4. DRAWING/CONTEST/NOTIFICATION/PRIZE CLAIM: Three contestants will be selected in a random drawing from among all eligible entries received to be held on or about September 7, 2009 conducted by an independent judging organization (“Sweepstakes Administrator”) whose decisions are final and binding on all matters relating to this Promotion. The odds of being selected as a contestant depend on the number of eligible entries. The entrants chosen as contestants will be notified by phone and/or overnight delivery service and will be required to sign and have notarized an affidavit of eligibility and liability/publicity release to be returned within 5 days of receipt and may be subject to a background check. Failure to return affidavit/release in the five days constitutes forfeiture of eligibility to be a contestant and a new contestant will be selected. The three (3) contestants will travel from their legal residence as arranged by the Sponsor and at Sponsor’s expense, and discretion, to a single Texas location selected by Sponsor during the period within 30 days after selection and confirmation of the contestants. Contestants will spend 2 nights in a select hotel and receive a check for a rental car to travel to location. There they will compete in a Landowners Challenge, which will include Washer Tossing, Cooler Packing, Charcoal Grilling and a test of their Texas knowledge. The contestant with the most points across the four contests will be the winner. In case of a tie, the tying contestants will be asked 3 Texas trivia questions. The first contestant to answer two correctly will be declared the winner. The Grand Prize will be awarded following completion of the contest. First Prizes will be shipped to the addresses provided by entrants within 4–6 weeks after the final competition date. All prizes will be awarded.

5. PRIZE CONDITIONS: No transfer or substitution of any prize is allowed, nor is there a cash value equivalent, except at the sole discretion of the Sponsor. All federal, state and other taxes, if applicable, are the sole responsibility of the winner. Winner’s entry and the acceptance of any prize constitutes permission (where allowable) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation.

6. PROMOTION CONDITIONS: Promotion is subject to all applicable federal, state and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the independent judging organization and waive any right to claim ambiguity in regard to the mechanics of the promotion or the interpretation of these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, its affiliates and their respective directors, officers, employees and agencies, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this Promotion. Sponsor is not responsible for illegible, damaged, lost, late, misdirected, or postage-due mailed entries or requests.
   
   Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Promotion, or by any technical or human error which may occur in the processing and/or transmissions in the Promotion. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to, or resulting from, participating in or downloading of materials in this contest. If, for any reason, the Promotion is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Internet portion of the Promotion, and select winners from all Internet entries received up to the time of termination, plus mailed entries.
   
   Liability for any irregular, damaged, or missing Official Entry Codes is limited to a free replacement (of the code only), while supplies last.
   
   Any person attempting to defraud or in any way tamper with the mechanics or logistics of this promotion will be declared ineligible and may be prosecuted to the full extent of the law.
